    • BY ENTERING (OR OTHERWISE PARTICIPATING) IN THE CONTEST, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING.  WITHOUT LIMITATION, SUCH CONTRACT INCLUDES GRANTS OF RIGHTS AND INDEMNITIES TO SPONSOR FROM YOU, A CLASS-ACTION WAIVER, AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

1.  SPONSOR.  Charles Schwab & Co., 2309 Gracy Farms Lane, Austin, TX 78758.

2.  CONTEST OVERVIEW.  The Schwab Hackathon (the "Contest") is a team-based coding contest for full-time students currently enrolled at the University of Texas.  Teams will be given a set amount of time to create an application (“Application”) in one of three categories (“Contest Categories”), as more fully described below. 

Registration and Pre-contest events begin at 2:30 pm. The Contest will take place at Sponsor’s office, located at 2309 Gracy Farms Lane, Austin, TX (“Event Site”), beginning at 7:00 p.m. Central Time (CT) on Friday, January 25, 2019, and ending at 11:00 a.m. CT on Saturday, January 26, 2019 (“Contest Period”).  Live demonstrations of the Applications to the judges will take place immediately after the Contest Period, between 11:00 a.m. CT and 1:00 p.m. CT on January 26, 2019, at the Event Site. 

Please see important instructions below for pre-registration and information on forming and entering your team.

3.  ELIGIBILITY. The Contest is open only to full-time students currently enrolled as undergraduate, graduate, or professional students in the McCombs School of Business, the College of Natural Sciences or the Cockrell School of Engineering at the University of Texas.  All students must be at least eighteen (18) years old as of January 25, 2019, and will be required to show identification confirming their student status at the University of Texas as part of the application/registration process.

4.  HOW TO PARTICIPATE.  Eligible students interested in participating in the Contest should do the following:

STEP 1:  Pre-Registration:  Before 11:59 p.m. on January 11, 2019, students must pre-register for the Contest using one of the following two methods:

(1) Complete and submit the RSVP form on the Contest Page located at https://mccombs.qualtrics.com/jfe/form/SV_7aFhhtaNEMMn9fD; or

(2) Send an email with the subject line “Schwab Hackathon Contest” to freddy.marichal@schwab.com with the following information:  (i) full name, (ii) email address, (iii) phone number, (iv) T-shirt size, and (v) academic degree/program of study.

PLEASE NOTE that, while all prospective entrants are required to pre-register, the Pre-Registration process itself does not constitute entry to the Contest.  The Pre-Registration process instead will be used by Sponsor for planning purposes and to assist in forming teams (to the extent necessary). 

STEP 2:  In-Person (Official) Registration:  In-person registration will take place at the Event Site between 2:00 p.m. and 4:00 p.m. on the day of the Contest – Friday, January 25, 2019.  Each entrant must be physically present at the Event Site during this time period to complete the entry form at the registration desk and to show proper student identification.  Entrants will be asked to provide the following information: first and last name, UT student identification number, phone, email, degree program, and team name (if known).

STEP 3:  Forming Your Team / Selecting Your Category: After completing the entry process, entrants must form into teams of between three (3) to five (5) individuals (a “Team”).  All entrants must have completed the registration process prior to joining a Team.  You may form your Team by: (i) organizing Team members in advance of the Contest, (ii) finding Team members at the Contest, or (iii) asking Sponsor for Team member suggestions, which Sponsor will provide prior to the start of the Contest Period.  Entrants are permitted to be on only one (1) Team.

After determining Team members, your Team will need to select one of the three Contest Categories in which your Team would like to compete.   The Contest Categories are:

  1. Smart Contracts on Ethereum PoA.  Teams in this category will be asked to create an Ethereum distributed application (DAPP) that is a data access management system.  The Application should behave such that the users of the system are able to perform their data activities, such as requesting and approving data access, using a familiar web-based interface and process workflow.
  2. “Hey, Don’t I Know You?” – Moving Beyond the Password in Authentication.  Teams in this category will be asked to create an Application or website that allows users to access their personalized content via password-less authentication.
  3. Keeping It in the Family with AI – Identifying and Keeping At-Risk Clients.  Teams in this category will be asked to create a risk exposure index for clients and identify the vectors for managing the risk.  The Application should provide additional channels for information to be entered into the system to identify clients more accurately.  Teams will also be asked to develop a marketing campaign and customer engagement process that can be targeted to each risk group and to propose how customer relationships can be maintained and monitored.

Once your Team has been assembled and has selected its Contest Category, please report back to the registration desk to identify your Team members, Contest Category, and Team name.

5.  CREATING AND SUBMITTING YOUR TEAM’S APPLICATION / APPLICATION REQUIREMENTS.  Each Team must create an Application for its chosen Contest Category during the Contest Period.  To do this, each Team member must create a devpost account profile by 7:00 p.m. on January 25, 2019 at https://devpost.com/.  In addition, each Team must select a Team member responsible for submitting the Team’s completed Application to the Contest’s devpost page.  Limit one (1) Application per Team.

The Application must be in compliance with the Submission Requirements set forth below and must be submitted to the Contest’s devpost page during the Contest Period – i.e., on or before 10:59.59 a.m. on January 26, 2019.  Applications submitted after 11:00.00 a.m. on January 26, 2019 will be deemed ineligible, so please plan accordingly.  Sponsor’s clock will be the official timekeeper for this Contest. Only entries that are recorded as received by Sponsor will be considered.

Application Requirements

Applications must be submitted during the Contest Period and in strict accordance with Sponsor’s instructions/requirements and these Official Rules.  Each Team/Team member should review all personal information for accuracy and correct any inaccurate data before submitting his/her/Team’s entry.

Applications must meet all of the following requirements:

    • Each entrant agrees that his/her participation in the Contest and agreement to these Official Rules, and Sponsor’s display and use of the Application, will not violate any other agreement to which entrant may be a signatory, party, or legally bound, or any other agreement that would prohibit entrant from participating in this Contest.
    • All aspects of the Application must be originally created by you (or a member of your Team) or be available for general use in the public domain.  All third-party content and/or content unoriginal to you (or your Team) is prohibited, unless such content is available for general use in the public domain.
    • Application must not infringe, misappropriate, or violate any rights of any third party including, without limitation, copyright, including moral rights, trademark, trade secret, or right of privacy or publicity.
    • Application must be unpublished and not have been submitted in any other contest, promotion, or competition.
    • Application must not include any malware, spyware, viruses or similar harmful code or content.
    • Application must not include information or content that is false, fraudulent, deceptive, misleading, defamatory, threatening, trade libelous, slanderous, libelous, disparaging, unlawfully harassing, profane, obscene, pornographic, hateful, indecent, inappropriate or injurious to any individual, Sponsor, or any third party.
    • Application must not suggest, depict, or describe any inappropriate, unlawful, or dangerous behavior or use of Sponsor’s or any other products or services.
    • Application must not contain or describe any harmful or illegal activity or content or in any way violate any federal, state, or local laws, rules, or regulations.
    • Application must be suitable for presentation in a public forum.

Applications that do not meet the foregoing requirements or these Official Rules may be disqualified in Sponsor’s sole discretion.  Sponsor further reserves the right to disqualify from the Contest any Team or Team member that, in Sponsor’s sole discretion, engages in poor sportsmanship, displays inappropriate behavior, fails to follow Sponsor’s instructions, or acts in any way that reflects negatively upon the Sponsor or the Contest.

Submission of the Application constitutes entrants’ certification that they are the creators of the Application and are submitting it in compliance with the requirements set forth above and these Official Rules.  By submitting an Application, entrants agree to indemnify and hold harmless Sponsor and its parent companies, subsidiaries, affiliates, sales representatives, agencies, retailers, wholesalers, distributors, and promotional and other vendor agencies involved in this Contest from any and all claims, damages, expenses, costs (including reasonable attorney fees) and liabilities (including settlements), resulting from or relating to submission, use, reuse, or display of the Application, or any information supplied or represented to Sponsor by entrants.  See Limitation of Liability section below for additional details.

By submitting an Application, for good and valuable consideration, entrants are granting to Sponsor a perpetual, unrestricted, irrevocable, royalty-free, fully sub-licensable and transferable worldwide exclusive license and permission to use, reproduce, edit, modify and exhibit, create derivative works of, transmit, distribute, and display of the Application, in any and all formats, whether now known or hereafter developed.  Winning entries will be required, if requested by Sponsor, to assign all rights, title, and interest in the winning Application to Sponsor. Please see License to Entry Material section below for additional details.

6.  WINNER SELECTION & NOTIFICATION.  Judging will take place immediately after the Contest Period, i.e., between 11:00 a.m. and 1:00 p.m. on January 26, 2019.  Teams will be required to do a presentation and live demonstration of their Applications to a panel of judges selected by Sponsor.  Specifically, each Contest Category will have a panel of three (3) judges who will select one (1) winning Team per Contest Category. 

Applications will be judged by the respective panel using a 100-point scale based on the following criteria:

    1. Innovative Solution (25 points max.)
    2. Technical Proficiency (25 points max.)
    3. User Experience and User Interface (25 points max.)
    4. Presentation and Live Demonstration (25 points max.)

The Application within each Contest Category that receives the highest total score will be the winner for that Contest Category.  In the event of a tie, the tied Application with the higher score in Technical Proficiency will be deemed the winner.  If there is a still a tie, the tied Application with the higher score in Innovative Solution will be deemed the winner.  All decisions by the judges are final and binding on all entrants.

The three (3) winning Teams (i.e., one winner in each Contest Category) will be notified/announced at the end of the judging period.  At least one (1) Team member from a winning Team must be present at the winner announcement at the end of the judging, or the Team will be deemed to have forfeited its prize.  Each Team member of a winning Team may be required, at Sponsor’s sole discretion, to complete, sign, have notarized (if applicable), and return to the address specified by Sponsor, without alteration and in the form presented by the Sponsor, an affidavit of eligibility, declaration and/or liability/publicity release (unless prohibited by law) and tax forms (if applicable) within the time frame designated by Sponsor.  In the event of noncompliance with these requirements, the winning Team may forfeit their individual prizes.  The affidavit of eligibility and liability/publicity release (if any) are subject to verification by Sponsor.  Sponsor reserves the right to modify the notification procedures in connection with the selection of any alternate potential winner, if any.

7.  PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”).  Three (3) winning Teams will be selected in total (i.e., one (1) winning Team in each of the three Contest Categories).  Each Team member of a winning Team will receive the following:

    • One (1) $500 Amazon.com gift card.  (ARV:  $500.)

All taxes, fees, and surcharges on prizes are the sole responsibility of the winners.  Gift cards may be subject to terms and conditions.  For prizes to an individual winner in excess of $600 in a calendar year, winners will be issued an IRS Form 1099 for the fair market value of the prize inclusive of sales or other transaction taxes.  Any and all guarantees and warranties for merchandise prizes are subject to the manufacturer’s and/or service providers’ terms and conditions, and winner agrees to look solely to such manufacturers and/or service providers for any warranty or guarantee claim.  Prizes are non-transferable except in the sole discretion of the Sponsor.  No substitution or cash equivalent is allowed.  Sponsor reserves the right to substitute prizes of the same approximate retail value.  Prize consists only of items specifically listed as part of the prize.  All costs and expenses not specified herein, related to any prize, including but not limited to delivery, installation, service activation fees, and other expenses or incidental costs incurred by accepting the prize, are the sole responsibility of the winner.  Prizes will be mailed to the winning Team members after each Team member has completed the requested documentation (if any) by using the contact information provided on the documentation.  Sponsor will not replace any lost, mutilated or stolen prize or any prize that is undeliverable or does not reach the winner because of an incorrect or changed address or other contact information.

8.  LICENSE TO ENTRY MATERIAL.  As a condition of entry, each Contest entrant grants Sponsor a perpetual, unrestricted, irrevocable, royalty-free, fully sub-licensable and transferable worldwide exclusive license and permission to use, reproduce, edit, modify and exhibit, create derivative works of, transmit, distribute, and display the Application, in any and all formats, whether now known or hereafter developed. 

With respect to the winning Applications only, as a condition of any prize award, each Team member of a winning Team (a “Winning Entrant”) further agrees to assign all rights, title, and interest in the winning Application to Sponsor, including all intellectual property rights in the Application, the exclusive right to secure trademark and copyright registrations and other rights for that Application (or any portion thereof) anywhere throughout the world, the exclusive right to license, exploit, sell, assign, or otherwise dispose of the Application or any of the said rights included therein for any purpose which the Sponsor may see fit, and any and all subsidiary rights to the Application.  A Winning Entrant will have no right of approval, review, or modification as to the future use, modification, or display of the Winning Entrant’s Application.  Winning Entrants shall have no right of compensation from, credit or attribution, or approval over any use of Application by Sponsor.  Winning Entrants hereby forever waive and relinquish all so-called “moral rights (droit moral)” now or hereafter recognized in connection with any Winning Application submitted as part of the Contest.  Winning Entrants further agree, as a condition of receiving any prize award, to execute any additional written authorization, assignment, or other papers requested by Sponsor in connection with the transfer and assignment of rights to his/her entry. Sponsor must receive any such requested written papers from each winning Team member before disbursing a prize to any member of that winning Team. Sponsor reserves the right to select another winner if each member of a winning Team fails to provide the requested written papers. 

Entrants agree not to issue any publicity concerning Sponsor.  Entrants agree that neither Sponsor nor its agents shall be responsible for return or preservation of the Applications submitted.  Sponsor has the right but not the obligation to post any Application for worldwide viewing on the Internet.  All Applications that are posted on Sponsor’s website, the Internet, or elsewhere may be available to be viewed by the public. 

9.  PUBLICITY RELEASE.  Please note that the Contest may be videotaped, recorded, or live-streamed on the Internet.  By entering the Contest (except where prohibited by law), each entrant grants the Sponsor the irrevocable, sub-licensable, free of charge, absolute right and permission to use, publish, post or display his or her name, photograph, likeness, voice, prize information, biographical information, any quotes attributable to him or her and any other indicia of persona (regardless of whether altered, changed, modified, edited, used alone, or used with other material in the Sponsor’s sole discretion) for advertising, trade, promotional and publicity purposes without further obligation or compensation of any kind to him or her, anywhere, in any medium now known or hereafter discovered or devised (including, without limitation, on the Internet), world-wide, without any limitation of time and without notice, review or approval and each participant releases Sponsor from any and all liability related to such authorized uses. Nothing contained in these Official Rules obligates the Sponsor to make use of any of the rights granted herein and winner waives any right to inspect or approve any such use.

10.  LIMITATION OF LIABILITY.  NOTHING IN THESE OFFICIAL RULES LIMITS, EXCLUDES, OR MODIFIES OR PURPORTS TO LIMIT, EXCLUDE OR MODIFY ANY STATUTORY CONSUMER GUARANTEES OR ANY IMPLIED CONDITION OR WARRANTY THE EXCLUSION OF WHICH FROM THESE TERMS AND CONDITIONS WOULD CONTRAVENE ANY STATUTE OR CAUSE ANY PART OF THESE OFFICIAL RULES TO BE VOID ("NON-EXCLUDABLE GUARANTEES"). SUBJECT TO THE LIMITATIONS IN THE PRECEDING SENTENCE, THE SPONSOR EXCLUDES FROM THESE OFFICIAL RULES ALL CONDITIONS, WARRANTIES, AND TERMS IMPLIED BY STATUTE, GENERAL LAW, OR CUSTOM EXCEPT FOR LIABILITY IN RELATION TO A NON EXCLUDABLE GUARANTEE.  SUBJECT TO ANY NON-EXCLUDABLE GUARANTEES, EACH PARTICIPANT AGREES TO RELEASE, HOLD HARMLESS AND INDEMNIFY THE SPONSOR AND ITS DIVISIONS, PARENT COMPANIES AND SUBSIDIARIES FOR ANY LIABILITY FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE USE, ACCEPTANCE, POSSESSION, MISUSE OR AWARDING OF THE PRIZE, WHILE PREPARING FOR, PARTICIPATING IN AND/OR TRAVELING TO OR FROM ANY PRIZE- OR CONTEST-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO PERSON OR PROPERTY (HOWEVER, ONLY IF REQUIRED BY LAW IN YOUR JURISDICTION, THIS RELEASE, HOLD HARMLESS AND INDEMNIFICATION COMMITMENT DOES NOT APPLY TO CASES OF BODILY INJURY OR LOSS OF LIFE OR TO THE EXTENT THAT ANY DEATH OR PERSONAL INJURY IS CAUSED BY THE NEGLIGENCE OF SPONSOR OR OTHER THIRD PARTY, WHERE LIABILITY TO THE INJURED PARTY CANNOT BE EXCLUDED BY LAW). THE WINNER AGREES THAT THe PRIZE IS PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, BEYOND ANY NON-EXCLUDABLE GUARANTEES.

11.  GENERAL RULES.  The Sponsor’s decisions will be final in all matters relating this Contest, including interpretation of these Official Rules and awarding of the prizes.  All entrants, as a condition of entry, agree to be bound by these Official Rules and the decisions of the Sponsor.  In case of complaints or disputes send an e-mail to freddy.marichal@schwab.com, and you will receive response within 14 business days.  Failure to comply with these Official Rules may result in disqualification from this Contest.

Entrants further agree to not damage or cause interruption of the Contest and/or prevent others from participating in the Contest. The Sponsor reserves the right to restrict or void participation from any IP address if any suspicious entry and/or participation are detected.  The Sponsor reserves the right, in its sole discretion, to void entries of any participants who the Sponsor believes have attempted to tamper with or impair the administration, security, fairness, or proper play of this Contest. The Sponsor’s failure to or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision.  In the event there is an alleged or actual ambiguity, discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials and/or these Official Rules (including any alleged discrepancy or inconsistency in these Official Rules), it will be resolved in the Sponsor’s sole discretion.  Entrants waive any right to claim ambiguity in the Contest or these Official Rules. If the Sponsor determines at any time in its sole discretion that a winner or potential winner is disqualified, ineligible, in violation of these Official Rules, or engaging in behavior that the Sponsor deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, the Sponsor reserves the right to disqualify that winner or potential winner, even if the disqualified winner or potential winner may have been notified or displayed or announced anywhere. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.  If the Contest is not capable of running as planned for any reason, the Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest and award the prizes based on entries received prior to cancellation, modification, or suspension or as otherwise deemed fair and appropriate by Sponsor.  If any person supplies false information, obtains entries by fraudulent means or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize, Sponsor may disqualify that person and seek damages from him or her and that person may be prosecuted to the full extent of the law. If a dispute cannot be resolved to Sponsor’s satisfaction as to who submitted an entry, the entry will be deemed ineligible. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST VIOLATES CRIMINAL AND CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

12.  ADDITIONAL DISCLAIMERS. To the extent permitted by the mandatory provisions of the applicable law, Sponsor is not responsible and/or liable for any of the following, whether caused by the Sponsor, the participant, or by human error (however, only if required by law in your jurisdiction, except to the extent that any of the following occur for reasons within Sponsor’s reasonable control, where liability to the injured party cannot be excluded by law):  any lost, late, incomplete, illegible, mutilated, or misdirected e-mail, mail, or Contest-related correspondence or materials; any error, omission, interruption, defect, or delay in transmission or communication; viruses or technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos or misprints in these Official Rules, in any Contest-related advertisements or other materials; failures of electronic equipment, computer hardware or software; lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or entry information.  Sponsor is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in participant’s e-mail account to receive e-mail messages.  Sponsor is not responsible, and may disqualify an entrant, if his or her e-mail address, telephone, or other contact information does not work or is changed without entrant giving prior written notice to Sponsor.  Sponsor is not responsible for any changes or unavailability of any web site that may interfere with the Contest or ability of entrant to timely participate, receive notices or communicate with Sponsor, in which case Sponsor, in its sole discretion, may terminate or modify the Contest.  Without limiting any other provision in these Official Rules, Sponsor is not responsible or liable to any entrant or winner or any person claiming through such participant or winner for failure to supply the prize or any part thereof in the event that any of the Contest activities or the Sponsor’s operations or activities are affected, as determined by the Sponsor in its sole discretion, including, without limitation, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any law, rule, regulation, order or other action adopted or taken by any governmental, federal, state, provincial or local government authority, or any other cause, whether or not specifically mentioned above.

Entries that are forged, altered, incomplete, lost, late, misdirected, mutilated, illegitimate, garbled, or generated by a macro, bot, or other automated means will not be accepted and will be void.  Entries made by any other individual or any entity or group, or originating at any web site other than as set forth specifically above, will be declared invalid and disqualified for this Contest.  Sponsor may keep all entrant information for up to five (5) years after completion of the Contest for business management and record keeping purposes. 

13.  PRIVACY. Each entrant agrees to the use of the personal information submitted when they enter as detailed in Sponsor’s Privacy Policy posted at https://www.schwab.com/public/schwab/nn/legal_compliance/privacy . The Sponsor also collects personal information in order to conduct the Contest.  Entrants give consent for Sponsor to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Contest, as detailed in Sponsor’s privacy policy and complying with applicable laws, regulations, and rules.  The entrant’s personal data will be used for the following purposes: (a) contact potential winners; and (b) if an entrant selects to receive additional information from the Sponsor on the entry form, to send additional information to that entrant.  Entrants have a right of access to, modification, and withdrawal of their personal data.  They also have the right of opposition to the data collection, under certain circumstances. To exercise such right, they may write to the Sponsor.  The data controller is the Sponsor.  The recipient of the data is the Sponsor.  If entrant provides consent, the Sponsor may also use the information for promotional, marketing, and publicity purposes.  Entrants should direct any request to access, update, or correct information to the Sponsor.  Please note that by participating in the Contest and accepting these Official Rules, you acknowledge and consent to the use of your data as set out above.

14.  Disputes/Governing Law.  Except where prohibited, as a condition of participating in this Contest, each Entrant agrees that any and all disputes that cannot be resolved between the entrant and any Contest Entity, claims and causes of action arising out of or connected with this Contest, or the prize awarded, or the determination of the winner must be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will an entrant be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-pocket expenses (if any), not to exceed ten dollars ($10 USD), and entrant further waives all rights to have damages multiplied or increased.

This Contest and any dispute arising under or related thereto (whether for breach of contract, tortious conduct or otherwise) will be governed by the internal laws of the State of Texas, without giving effect to its conflicts of law or choice of law principles or rules that would cause the application of any other state’s/province’s/federal laws. Any legal actions, suits or proceedings related to this Contest (whether for breach of contract, tortious conduct or otherwise) will be brought exclusively in the state or federal courts located in Austin, Texas, and each participant accepts and submits to the personal jurisdiction of those courts with respect to any legal actions, suits or proceedings arising out of or related to this Contest.
